
First, once we have enough signed cards
submitted to Transport Workers Union (TWU), they, in turn, notify the
National Labor Relations Board (NLRB) that we would like to have a vote
for Union Representation as members of TWU. At this time, and this is
huge, MandalayBay cannot change anything regarding our employment
situation, regardless of whatever happens. It, in essence, stops
the bleeding. MandalayBay may not, at this time, institute the Wynn tip
policy. No layoffs can take place. Without our consent, no benefits can be taken away, and none added.
We’re not holding our breath for the latter anyway. No promises can be
made regardless of the outcome of the election to follow.
There’s an interesting side note about promises. MandalayBay may promise
supervisors anything that they desire should the Union election fail.
For instance, they could promise you bonuses and or a marvelous trip for
two and they will not be legally liable
for following through, unless it is in the form of a Contract. They could even tell supervisors that, for
instance, dealers will all get big raises and better insurance if the
Union drive fails, but they still would not be required to follow
through after the election. After all, it’s hearsay by the time that it
gets to us, and no direct promise was made to us.
Back to the process at hand, an election will
be held, frequently on the employer's premises, under the direct
supervision of the National Labor Relations Board. One simple
untraceable card will be issued per voter with two choices: Yes or No.
Only one box should be checked, followed by dropping the card in a box.
There's no computerized survey, and no way that MandalayBay will know who
voted in which way. Votes are tallied. When the election is
a success, the votes are certified, and MandalayBay must now negotiate a
contract with us. Representation from within our ranks is elected, and the process for
our Collective
Bargaining Agreement begins.
We have done a great deal of work and
preparation for this Union drive. For those who are reading this and
think that Unionizing could help our situation, but don't want to get involved, you still must submit your
authorization card to help. You need not participate in anything else other than voting
“Yes.”
